General Terms and Conditions (GTC)
for the online shop www.evimhome.de
1. Scope and Definitions
The following terms and conditions apply to all orders placed via the online shop www.evimhome.de , operated by:

Definitions of terms:
- Customer : any person who orders goods or services in the online shop.
- Consumer : according to § 13 BGB, any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
- Entrepreneur : according to § 14 BGB, any natural or legal person or legally capable partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.
- Online shop : the ordering platform at www.evimhome.de .
- Delivery address : the address specified by the customer within the Federal Republic of Germany to which the goods will be delivered.
- Working days : Monday to Saturday, excluding public holidays in the state of Hesse .
These terms and conditions apply exclusively. Any differing or conflicting terms and conditions of the buyer are not recognized unless the seller expressly agrees to their validity in writing.
2. Contracting parties and conclusion of the contract
The offers in the online shop are exclusively aimed at consumers with a delivery address in Germany.
The customer submits a binding offer to purchase the items contained in the shopping cart by completing the online ordering process and finally clicking the "Place order" button.
A legally binding purchase agreement only comes into effect when the seller
- the order is confirmed by an explicit declaration of acceptance (e.g. by e-mail),
- or the goods are shipped to the customer.
A mere confirmation of receipt of the order does not yet constitute acceptance of the contract .
Contracts for quantities larger than usual for household use, as well as commercial resale, require explicit confirmation from the seller.
The contract will be concluded in German. Order data will be stored in accordance with applicable data protection regulations and the GDPR .
3. Prices and shipping costs
All prices are final prices in euros (EUR) , include the applicable statutory value added tax (currently 19%) and are exclusive of shipping costs .
Shipping costs and any applicable surcharges (e.g., for items requiring freight forwarding or oversized goods) are clearly displayed during the ordering process. The prices valid at the time of ordering apply.
There are no hidden fees or costs.
4. Delivery and delivery time
Delivery will take place within the delivery time specified on the respective product page.
For payments made in advance , the delivery period begins upon receipt of payment .
For other payment methods (e.g. PayPal, credit card, instant bank transfer, purchase on account), the delivery period begins upon conclusion of the contract.
Working days are defined as Monday to Saturday, excluding national and Hessian public holidays .
When ordering multiple items, the longest stated delivery time applies to the entire order.
Should an item be temporarily unavailable, the customer will be informed immediately.
5. Payment terms
The following payment options are available:
- credit card
- PayPal
- Instant bank transfer
- SEPA Direct Debit
- prepayment
- Purchase on account (after credit check)
- Financing (via third-party providers, e.g. banks or payment service providers)

If you choose prepayment as your payment method, the full invoice amount must be transferred within 3 business days of order confirmation. The goods will be reserved for this period.
SEPA Direct Debit
When paying by SEPA direct debit, the customer grants a corresponding basic mandate. The pre-notification of the direct debit collection takes place two days before the collection date .
Purchase on account
When purchasing on account through our partner Klarna, the invoice amount is payable to Klarna within 30 days of shipment of the goods. Payment processing is handled exclusively by Klarna. Klarna's terms and conditions apply. .
Delay
In case of late payment or chargeback, the seller may claim reminder fees, default interest and costs of external debt collection service providers.
Offsetting against claims of the seller is only permissible with undisputed or legally established counterclaims.
6. Retention of title
The delivered goods remain the property of Evim Mobilya GmbH until full payment has been received.
7. Warranty (rights in case of defects)
The statutory warranty rights apply (§§ 434 ff. BGB).
The warranty period for consumers is two years from delivery of the goods .
Any manufacturer's warranties remain unaffected.
The special provisions of Section 8 apply to claims for damages by the customer.
8. Liability
The seller is liable without limitation for damages.
- which are based on intent or gross negligence ,
- as well as in cases of injury to life, body or health.
In the case of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable, typical contractual damage .
Essential contractual obligations are those whose fulfillment is necessary for the proper execution of the contract.
Furthermore, liability is excluded.
The provisions of the Product Liability Act remain unaffected.
9. Right of withdrawal for consumers
Cancellation policy
Consumers have the right to withdraw from this contract within 14 days without giving any reason.
The period begins as soon as the buyer or a designated third party (not the carrier) has received the goods.
To exercise your right of withdrawal, a clear declaration (e.g. letter or email) to:

To meet the deadline, it is sufficient to send the declaration in good time.
Consequences of the revocation:
The seller will refund all payments, including delivery costs (excluding additional costs for alternative shipping methods), within 14 days of receiving the cancellation notice.
The refund will be issued using the same payment method that was used for the original transaction.
The seller can refuse to issue a refund until they have received the goods back or proof of shipment.
The customer bears the costs of the return shipment .
The customer is only liable for a loss in value if this is due to handling of the goods that was not necessary for checking their condition, properties and function.
10. Exclusion and expiry of the right of withdrawal
There is no right of withdrawal for contracts that do not include:
- about goods that are not prefabricated and are manufactured according to customer specifications or are clearly tailored to personal needs,
- about perishable goods or goods with an expiration date.
The right of withdrawal expires prematurely in the following cases:
- Delivery of sealed goods which are not suitable for return for reasons of health protection or hygiene once the seal has been removed,
- Delivery of goods which, after delivery, have become inseparably mixed with other goods,
- Delivery of audio/video recordings or software if their seal has been removed after delivery,
- Delivery of digital content, if the performance has begun with the express consent of the consumer before the expiry of the withdrawal period.
11. Jurisdiction and applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
For disputes with merchants, legal entities under public law or special funds under public law, the exclusive place of jurisdiction is Hanau .
For consumers, the statutory rules of jurisdiction apply.
12. Disposal of waste electrical and electronic equipment, batteries and rechargeable batteries
Consumers are legally obliged to dispose of old devices and batteries separately from household waste .
Old appliances can be disposed of free of charge at municipal collection points or after prior request to shop@evimhome.de can be returned using the free return label.
Before returning the item, personal data must be deleted and loose batteries removed.
Batteries containing hazardous substances are marked accordingly (symbols: Pb for lead, Cd for cadmium, Hg for mercury).
13. Online Dispute Resolution / Mediation
The EU Commission provides a platform for online dispute resolution:

The seller makes every effort to resolve any disagreements amicably.
Participation in a conciliation procedure is not offered and is not mandatory .
14. Final Provisions

German law applies, excluding the conflict-of-laws rules of private international law and the UN Convention on Contracts for the International Sale of Goods.
Mandatory consumer protection regulations of the country in which the consumer has their habitual residence remain unaffected. -
Should individual provisions of these terms and conditions be invalid, the validity of the remaining provisions shall remain unaffected.
The parties undertake to reach an effective agreement that comes closest to the economic purpose of the ineffective provision.
15. Validity
These General Terms and Conditions will come into effect on November 7, 2025 and will supersede all previous versions.
